Absolutely not! That was a man standing outside of the Granny’s who once made the wrong choice. He could’ve gave up The Jolly Roger and saved Prince Eric, but he considered himself a pirate and pirates are not merciful. He specifically said it to Emma that “No matter how hard you try to go back to your old life, you just can’t” And throughout the episode we found out the either way he lost his ship. I believe what he’d done to Ariel haunted him, and after receiving a message that there is a way to be reunited with Emma, but for a price. And his price was to give up his ship. 

He thought after he confesses to Ariel for what he has done in the past year, it would change things a bit. He will not feel as guilty as he felt before. And now the Charmings are considering him a part of their family, he has found a family. And no matter what he will protect them, even if it means staying away from them forever. He’d lost enough people in his life, he can’t loose the people that he cares for and considers them as his family and of course his true love. 

And for the first time ever, Emma is giving him attention. She was the one who kind of invited him for dinner. But he puts a smile on his face and tells her that he can’t. So when he was looking at her from a far, he wanted to make sure that this time he made the right choice. He made sure that they’re happy. And the easiest way to explain this is with this gif:
